Section 6021.1301 - Withholding permitThe department shall not issue any permit pursuant to this act or amend any permit issued under this act, and may revoke any permit previously issued under this act, if it finds, after investigation and an opportunity for informal hearing, that:
(1) the applicant has failed and continues to fail to comply with any provisions of Federal or State law which are in any way connected with or related to the regulation of storage tanks or of any relevant rule, regulation, permit or order of the department or related to the regulation of storage tanks.(2) the applicant has shown a lack of ability or intention to comply with any law, rule, regulation, permit or order of the department issued pursuant to this act as indicated by past or continuing violations. Any person, partnership, association or corporation which has violated this act, rule, regulation, order of the department, or any condition of any permit issued pursuant to this act, or which has a partner, associate, officer, parent corporation, subsidiary corporation, contractor or subcontractor which has engaged in such violation shall be denied any permit required by this act unless the permit application demonstrates that the violation is being corrected to the satisfaction of the department.1989, July 6, P.L. 169, No. 32, § 1301, effective in 30 days.
