Section 984 - Samples of food for analysis, methods of taking

Whenever the duly authorized officer or representative of any city, county, township, incorporated town or borough hereafter shall desire to obtain a sample of any food or processed food for the purpose of making an analysis, or analyses, or examination thereof, such officer or agent shall do so in either of the following manners:

(a) The sample shall be divided in the presence of the person of whom the request or demand for the sample was made, or before a witness, into two or more parts and each part shall be sealed in a suitable package. One part shall be tendered, and if accepted, shall be delivered to the person of whom the request or demand was made, together with a statement in writing that such sample was taken for the purpose of analysis or examination, which statement shall be signed by the officer or representative taking the sample; or
(b) Another sample of the identical product shall be taken in the presence of the person of whom the request or demand for the sample was made, and this sample shall be delivered to the person of whom the request or demand was made, together with a statement in writing that another sample of the identical product was taken for the purpose of analysis or examination, which statement shall be signed by the officer or representative taking the sample.
