Section 6250.1404 - Workers' Compensation(a) Department.--The department shall purchase or arrange for workers' compensation insurance coverage for approved claimants during their participation in the program with an approved business.(b) Employment relationship.--A claimant's participation in the program does not create an employment relationship with the department for purposes of the act of June 2, 1915 (P.L.736, No.338), known as the Workers' Compensation Act.(c) Computation.--For the purposes of computing an approved claimant's wage compensation and benefit amount under the Workers' Compensation Act: (1) the average weekly wage shall be the claimant's maximum weekly unemployment compensation benefit rate for the benefit year in effect at the time of injury; and(2) the unemployment compensation benefit offset permitted under section 204(a) of the Workers' Compensation Act shall not apply.Added by P.L. 970 2012 No. 107, § 2, eff. 7/5/2012.
