Section 409 - Vacancies not otherwise provided for
(a) Except as otherwise provided in subsection (b), in case of a vacancy, happening by death, resignation or otherwise, in any county office created by the Constitution or laws of this Commonwealth, and where no other provision is made by the Constitution, or by this act, to fill the vacancy, it shall be the duty of the Governor to appoint a suitable person to fill such office, who shall continue to hold and discharge the duties of the office until the first Monday in January following the next municipal election occurring not less than ninety days after the occurrence of the vacancy, or for the balance of the unexpired term, whichever period is shorter. If there is a municipal election occurring not less than ninety days after the occurrence of the vacancy, other than the one at which the office ordinarily is filled, then the office shall be filled at that election for the balance of the unexpired term. Such appointee shall be confirmed by the Senate if in session.
(b) In counties of the second class A, the appointed person shall continue in office and discharge the duties of the office for the balance of the unexpired term.
(c) The Governor shall discharge the duties set forth in this section in accordance with section 207.1(d)(5.1) of the act of April 9, 1929 ( P.L. 177, No.175), known as "The Administrative Code of 1929."
