Section 3712.2 - Stripping abandoned vehicles(a) Offense defined.--(1) Except as provided in paragraph (2), a person commits the offense of stripping an abandoned vehicle if the person intentionally removes any part of an abandoned vehicle.(2) Paragraph (1) does not apply if the person:(i) is the owner of the vehicle or the owner's agent; or(ii) is authorized to make the removal under Chapter 73 (relating to abandoned vehicles and cargos).(b) Penalties.--Any person violating subsection (a): (1) For a first offense, commits a misdemeanor of the third degree.(2) For a subsequent offense, commits a felony of the third degree.(c) Complaints.--In a case involving a violation of this section, the municipality in which the vehicle is located may file the complaint with the appropriate issuing authority.2002, Dec. 9, P.L. 1278, No. 152, § 8, effective in 60 days.
