Section 678.440 - Nursing assistants; training; effect of employing untrained assistant; civil penalties(1) As used in this section and ORS 678.442, 678.444, 678.445, 678.447 and 678.448, "nursing assistant" means an individual who assists licensed nursing personnel in the provision of nursing care.(2) It is the intent of the Legislative Assembly to require that nursing assistants be adequately trained.(3) The Oregon State Board of Nursing shall prepare curricula and standards for training programs for nursing assistants. The curricula and standards must provide for additional training for nursing assistants to have the authority to administer noninjectable medications.(4) The Department of Human Services may impose civil penalties or revoke the license of any long term care facility that employs an untrained nursing assistant for a period of more than eight weeks without providing for the training prescribed by the board. Any license that is revoked shall be revoked as provided in ORS 441.030.(5) The Oregon Health Authority may impose civil penalties or revoke the license of a health care facility that employs any untrained nursing assistant for a period of more than eight weeks without providing for the training prescribed by the board.
