Rule 9 - Petition - Form and Style

A separate petition shall be filed against each judicial officer sought to be removed from office or retired from office.

A petition against a judicial officer for removal from office shall state upon its face one or more of the following grounds:

Gross neglect of duty;

Corruption in office;

Habitual drunkenness;

Commission while in office of any offense involving moral turpitude, gross partiality in office;

Oppression in office;

Any other grounds as may be specified hereafter by the Legislature of the State of Oklahoma.

A petition for compulsory retirement from office, with or without compensation, against a judicial officer shall state upon its face one or more of the following grounds:

Mental disability preventing the proper performance of official duty;

Physical disability preventing the proper performance of official duty;

Incompetence to perform the duties of the office.

Each petition against a judicial officer shall be verified by the Supreme Court or the Chief Justice thereof; by the Governor; by the Attorney General; by the Executive Secretary of the Oklahoma Bar Association; or by the Speaker of the House of Representatives of the State of Oklahoma.

When the Executive Secretary of the Oklahoma Bar Association files the petition at the direction of the House of Delegates, a certified copy of the resolution of said House of Delegates shall be attached thereto.

When the petition is filed by the Speaker of the House of Representatives, a certified copy of the resolution of the House of Representatives of the State of Oklahoma shall be attached thereto.

The petition shall state the name of the respondent; the grounds upon which his removal from office or compulsory retirement from office is sought and the facts, succinctly stated, upon which action is sought against the respondent shall be stated in the petition.

The petition shall show upon its face the names and addresses of the witnesses for the prosecution.

The petition shall be verified substantially in the following form:
