Section 923.49 - Misbranded commercial feedA commercial feed is misbranded if any of the following occur:
(A) The labeling is false or misleading in any particular;(B) It is distributed under the product or brand name of another commercial feed;(C) It does not meet the label requirements of section 923.43 of the Revised Code or any rule adopted under that section;(D) It purports to be or is represented as a commercial feed or it purports to contain or is represented as containing a feed ingredient when it does not conform with the definition of that commercial feed or feed ingredient which the director shall establish by rule;(E) Any word, statement, or any other information required under section 923.43 of the Revised Code or any rule adopted under that section to appear on the label is not prominently placed on the label with such conspicuousness as compared with other words, statements, designs, or devices and in such terms as to render it likely to be read and understood by the ordinary individual under customary conditions of purchase and use.Effective Date: 7/27/1990
