Section 3701.19 - Poison control network definitionsAs used in sections 3701.19 to 3701.201 of the Revised Code:
(A) "Poison prevention and treatment center" means an entity designated as a poison prevention and treatment center by the director of health under section 3701.20 of the Revised Code.(B) "Harm" means injury, death, or loss to person or property.(C) "Tort action" means a civil action for damages for injury, death, or loss to person or property. "Tort action" includes a product liability claim that is subject to sections 2307.71 to 2307.80 of the Revised Code, but does not include a civil action for a breach of contract or another agreement between persons.(D)(1) Subject to division (D)(2) of this section, "volunteer" means a trustee, officer, or agent of a poison prevention and treatment center, or another person associated with such a center, who satisfies both of the following: (a) Performs services for or on behalf of, and under the authority or auspices of, the center;(b) Does not receive compensation, either directly or indirectly, for performing those services.(2) For purposes of division (D)(1) of this section, "compensation" does not include any of the following: (a) Actual and necessary expenses that are incurred by a volunteer in connection with the services performed for a center, and that are reimbursed to the volunteer or otherwise paid;(b) Insurance premiums paid on behalf of a volunteer, and amounts paid or reimbursed, pursuant to division (E) of section 1702.12 of the Revised Code;Effective Date: 2/12/2004.
