Section 3328.23 - Students with disabilities(A) A college-preparatory boarding school established under this chapter shall comply with Chapter 3323. of the Revised Code as if the school were a school district. For each child with a disability enrolled in the school for whom an IEP has been developed, the school shall verify in the manner prescribed by the department of education and workforce that the school is providing the services required under the child's IEP.(B) The school district in which a child with a disability enrolled in the college-preparatory boarding school is entitled to attend school and the child's school district of residence, if different, are not obligated to provide the student with a free appropriate public education under Chapter 3323. of the Revised Code for as long as the child is enrolled in the college-preparatory boarding school.Amended by 135th General Assembly, HB 33,§130.100, eff. 10/3/2023.Amended by 129th General Assembly, HB 157, §1, eff. 12/21/2011.Added by 129th General Assembly, HB 153, §101.01, eff. 9/29/2011.
