Section 4.1-31-26 - Penalties1. A person who willfully violates a provision of this chapter is guilty of a class A misdemeanor.2. A person willfully violating this chapter or a rule adopted under this chapter is subject to a civil penalty not to exceed two hundred fifty dollars for each violation. The civil penalty may be imposed by a court or by the agriculture commissioner in an administrative proceeding.3. Imposing a penalty allowed in subsection 1 or 2 does not preclude the commissioner from seeking to impose other sanctions or from seeking other remedies for violation of this chapter or rules adopted under this chapter.Added by S.L. 2017, ch. 68 (SB 2028),§ 5, eff. 7/1/2017.
