Section 58:10C-6 - Rules, regulations
a. No later than 18 months after the date of enactment of P.L. 2009, c. 60(C.58:10C-1 et al.), the board shall, pursuant to the "Administrative Procedure Act," P.L. 1968, c.410 (C.52:14B-1 et seq.), adopt rules and regulations necessary for the implementation, administration, and enforcement of P.L. 2009, c. 60(C.58:10C-1 et al.). The rules and regulations shall:
(1) establish requirements for the education, continuing education, training, experience, examination and testing, and references for the licensing of site remediation professionals;
(2) establish standards for professional conduct of, and the payment of fees by, licensed site remediation professionals;
(3) establish procedures for the investigation of complaints concerning licensed site remediation professionals initiated by any person;
(4) establish other forms of nonmonetary penalties that the board may impose on a licensed site remediation professional pursuant to section 17 of P.L. 2009, c. 60(C.58:10C-17); and
(5) provide for enforcement of the provisions of P.L. 2009, c. 60(C.58:10C-1 et al.). The rules and regulations shall establish an expiration date for temporary site remediation professional licenses issued by the department pursuant to section 12 of P.L. 2009, c. 60(C.58:10C-12).
b. The rules and regulations adopted pursuant to this section shall be sufficient to assure that any response action outcome issued by a site remediation professional licensed pursuant to P.L. 2009, c. 60(C.58:10C-1 et al.) shall be consistent with all applicable laws, rules and regulations concerning the remediation of contaminated sites and shall protect public health and safety and the environment.
