Section 45:7-61 - Operating and maintaining mortuary; conditionsNo person shall operate, maintain or use a mortuary within this State unless:
(a) He, they or it shall annually register with the board in accordance with the provisions of section twenty-four of this act;(b) The certificate of registration issued by the board shall be conspicuously displayed within the establishment;(c) The licenses of the individual owner, of all partners, or of the manager of the establishment in all cases where the establishment is not managed by a licensed individual owner or licensed partners, shall be conspicuously displayed within the establishment;(d) It shall be under the immediate and personal supervision, direction, management, and control of a person duly licensed as a practitioner of mortuary science, under the provisions of this act, or of a person duly licensed as a funeral director under the provisions of this act or of any prior law of this State; and all funeral directing shall be under the immediate and personal supervision, direction, management, and control of a person duly licensed as a practitioner of mortuary science, under the provisions of this act, or of a person duly licensed as a funeral director under the provisions of this act or of any prior law of this State;(e) Its construction, maintenance and operation shall conform to the rules and regulations of the board promulgated to safeguard and promote the public health, safety, morals and welfare.L.1952, c.340, p.1111, s.30.
