Subject to the provisions of section 8 of P.L. 2008, c. 50(C.26:6-84), an anatomical gift of a donor's body or part may be made during the life of the donor for the purpose of transplantation, therapy, research, or education in the manner provided in section 5 of P.L. 2008, c. 50(C.26:6-81) by:
a. the donor, if the donor is an adult, or if the donor is a minor 14 years of age or older, whether or not the minor is emancipated;b. an agent of the donor, unless the advance directive for health care or other record prohibits the agent from making an anatomical gift;c. a parent of the donor, if the donor is an unemancipated minor; ord. the donor's guardian. An anatomical gift made by a minor donor shall remain valid when the minor reaches 18 years of age.
