Section 399-G:35 - Unlicensed PersonsI. If the commissioner has reason to believe that a person has violated or is violating RSA 399-G:7, the commissioner may issue an order to show cause why an order to cease and desist should not issue requiring that the person cease and desist from the violation.II. In an emergency the commissioner or, if the commissioner delegates the attorney general to do so, the attorney general may petition the superior court for the issuance of a temporary restraining order ex parte pursuant to the rules of civil procedure.III. An order to cease and desist becomes effective upon service of it upon the person.IV. An order to cease and desist remains effective and enforceable pending the completion of an administrative proceeding pursuant to RSA 541-A.V. A person that is served with an order to cease and desist for violating RSA 399-G:7 may petition the superior court for a judicial order setting aside, limiting, or suspending the enforcement, operation, or effectiveness of the order pending the completion of an administrative proceeding pursuant to RSA 541-A.VI. An order to cease and desist expires unless the commissioner commences an administrative proceeding within 10 days after it is issued.Added by 2024, 368:1, eff. 10/22/2024.
