Section 204-C:74 - Administration; Eligibility; DemonstrationI. The authority shall make a good faith effort to approve applications from both nonprofit and for-profit child care organizations and business organizations which currently provide or are planning to provide child care services for their employees, consistent with the minimum criteria established in this section. When entering into contracts for guaranteed loans pursuant to this subdivision, the authority shall require that applicants demonstrate that they, at a minimum, meet the requirements of paragraphs II and III.II. Each applicant shall: (a) Agree to apply for or hold a child care provider license pursuant to RSA 170-E.(b) Register with the state as a private, nonprofit or for-profit child care organization or be a registered business organization which provides or plans to provide child care services to its employees.(c) Address both a geographic and community need for projected service or agree to provide service to infants and toddlers.(d) Agree to provide service to children who are eligible for Title XX assistance under Public Assistance Manual ITEM 390, sections 3980-3983.(e) Be fiscally sound as shown in a financial statement.(f) Agree to comply, if an applicant establishing a center or program, or comply with, if an existing child care provider, state and local public health, fire and life safety codes and zoning requirements.III. Each applicant shall either: (a) Seek a loan guarantee in order to renovate a facility or facilities to comply with life safety, fire, health, or other public codes, whether state or local, and shall demonstrate expected costs of such compliance; or(b) Seek a loan guarantee in order to make capital expenditures necessary to meet licensing requirements related to planned establishment or expansion and shall demonstrate expected costs of such compliance.IV. Loan guarantee recipients shall demonstrate to the authority the disposition of any moneys provided under the child care provider guaranteed loan program.1989, 411:3, eff. July 1, 1989.
