Section 4:9-n - Fallen State Troopers' MemorialI. There shall be a memorial to commemorate law enforcement members of the division of state police who gave their lives in the performance of duty. Notwithstanding other provisions of law to the contrary, the memorial shall be situated on the grounds of or on state owned land adjacent to the state police headquarters at the James H. Hayes Safety Building on Hazen Drive in the city of Concord. The governor is authorized to accept in the name of the state the fallen state troopers' memorial as a private gift to the state upon its completion.II. The commissioner of the department of administrative services, or designee, shall act as the custodian for the memorial, and shall have charge of all matters relating to the care, maintenance, and repair of, and additions to, the memorial. For the purpose of this section the provisions of RSA 21-I shall not apply.III. The commissioner of the department of administrative services, or designee, shall administer and disburse to the committee established in RSA 4:9-o, the moneys in the special nonlapsing account established in RSA 4:9-o.IV. No person shall use the fallen state troopers' memorial for any commercial purpose. This prohibition shall not apply to use by the New Hampshire Troopers Association or any other nonprofit law enforcement organization registered with the director of charitable trusts to fund the upkeep and maintenance of the memorial provided that the use of the memorial is approved by the department of administrative services and by the committee established in RSA 4:9- o. Any person or organization that violates the provisions of this paragraph shall be guilty of a violation and subject to a fine of $500 plus penalty assessment.
