If such bond or evidence that such bond is filed in another state is filed, any person defrauded or injured by any wrongful act, misrepresentation or failure on the part of a motor club with respect to the selling or rendering of any of its services may bring suit on such bond in the person's own name; but the aggregate liability of the surety for all such suits shall, in no event, exceed the sum of such bond.
