Section 561.295 - Issuance and enforcement of hold orders by Director; hearings; judicial review1. The Director may issue and enforce a written hold order to the owner or custodian of any agricultural commodity, livestock, livestock product, appliance, material or article which the Director finds is in violation of any of the provisions of law administered by the Department or which the Director finds to be infested with a pest or infected with a disease. The order may prohibit further sale or movement or require that the agricultural commodity, livestock, livestock product, appliance, material or article to be held on the premises or at a designated premise until the Director has evidence that the order has been complied with, and upon compliance, the order must be dissolved.2. It is unlawful to move or otherwise dispose of any agricultural commodity, livestock, livestock product, appliance, material or article except with the permission of the Director and for the purposes specified therein. Upon demand, the owner or custodian of the agricultural commodity, livestock, livestock product, appliance, material or article has the right to a hearing before the Director relative to the justification of any such order. The provisions of this section do not limit the right of the Department to proceed as authorized by law.
