"Postsecondary educational institution" means an academic, vocational, technical, home study, business, professional or other school, college or university that is privately owned, or any person offering postsecondary education if he or she:
1. Is not licensed as a postsecondary educational institution in this state by a federal or another state agency;2. Charges tuition, requires or requests donations or receives any consideration from a student for any portion of the instruction, including written or audiovisual material;3. Educates or trains persons who are not his or her employees; and4. Educates or trains, or claims or offers to educate or train, students in a program leading toward: (a) Employment at a beginning or advanced level;(b) Educational credentials;(c) Credits that are intended to be applied toward an educational credential awarded in another state which does not require the person to obtain a majority of the credits required in that state; or(d) Preparation for examinations for initial licensing in a profession or vocation.The term includes a branch or extension of a public or private postsecondary educational institution of another state that is located in this state or which offers educational services or education in this state. The term does not include an institution or person offering only educational services or programs at the introductory level on the use of computer software to persons who have purchased that software from the institution or person.
