Section 318A.150 - Protests against organization of district; findings; ordinances creating or not creating district
1. Any person who owns property which is located within the proposed area of the district may, on or before the date of the hearing, submit a written protest to the creation of the district.
2. The governing body shall give full consideration to all protests which have been submitted and hear all persons desiring to be heard and, thereafter, adopt an ordinance creating the district or determining that the district must not be created.
3. Except as otherwise provided in NRS 318A.160, at the hearing to consider the creation of the district or at a subsequent hearing to which the hearing is adjourned, the governing body may create the district by ordinance if the governing body makes findings that the creation of the district is economically sound and feasible.
4. Any ordinance creating a district may:
(a) Contain changes to the proposed name, powers, purpose or boundaries of the district as may be considered by the governing body to be equitable and necessary.
(b) Require that the creation of the district is only effective upon approval by a majority of voters who live within the boundaries of the district at the next general election.
