Section 75-8-102 - Findings - intent(1) The legislature, mindful of its constitutional obligations under Article II, section 3, and Article IX of the Montana constitution, has enacted the Coal-Fired Generating Unit Remediation Act.(2) It is the legislature's intent that the requirements of this part ensure that appropriate remedies are in place when a coal-fired generating unit is retired to ensure the protection of the environmental life support systems from degradation and to provide adequate remedies to prevent unreasonable degradation of natural resources.Added by Laws 2017, Ch. 320,Sec. 2, eff. 5/4/2017, and applicable retroactively, within the meaning of 1-2-109, to a coal-fired generating unit retired on or after 1/1/2017.
