Section 50-50-209 - Cancellation of license
(1) Except as provided in subsection (2), the department may cancel the license of a retail food establishment if the department finds, after proper investigation, that the licensee has violated this chapter or a rule effective under this chapter and the licensee has failed or refused to remedy or correct the violation.
(2) A local regulatory authority may cancel a temporary food establishment permit if the local regulatory authority finds after proper investigation that the permitholder has:
(a) violated the provisions of this chapter or a rule promulgated under this chapter; and
(b) failed or refused to remedy or correct a violation that was the subject of the investigation.
