Section 50-12-109 - State action prohibited(1) An official, employee, or agent of the state of Montana may not block or attempt to block a patient's access to an investigational drug, biological product, or device.(2) Counseling, advice, or a recommendation consistent with medical standards of care from a licensed health care provider is not a violation of this section.Amended by Laws 2023, Ch. 413,Sec. 8, eff. 10/1/2023.Added by Laws 2015, Ch. 135, Sec. 9, eff. 3/27/2015.
