Section 25-34-21 - Persons who may perform notarial acts(1) A notarial act may be performed in this state by: (a) A notary public of this state;(b) An elected judge, a clerk or deputy clerk of a court of this state; or(c) The Mississippi Secretary of State or a Mississippi Assistant Secretary of State.(2) The signature and title of an individual performing a notarial act in this state are prima facie evidence that the signature is genuine and that the individual holds the designated title.(3) The signature and title of a notarial officer described in subsection (1) conclusively establish the authority of the officer to perform the notarial act.Added by Laws, 2020, ch. 382, HB 1156,§ 11, eff. 7/1/2021.
