Section 324.44504 - Rules establishing minimum safety standards for charter boats; vessel ventilation and rail height(1) The department shall promulgate rules to establish minimum safety standards for charter boats. The safety standards shall be designed to ensure the safety and well-being of persons utilizing a charter boat and shall include all of the following: (a) Methods for determining that a charter boat is of a structure suitable for carrying passengers and crew and is in a condition to enable it to be navigated safely.(b) Necessary equipment and operating requirements.(c) Minimum public liability insurance requirements.(d) Methods for determination of maximum passenger capacity.(e) Suitable tests to determine the sufficiency of the charter boat's structure, equipment, and stability.(2) Except rules addressing vessel ventilation and rail height, rules pertaining to safety standards promulgated under the authority of former Act No. 228 of the Public Acts of 1965 shall remain in effect as provided in section 44526. Vessel ventilation and rail height shall be consistent with generally accepted and federally approved manufacturing processes.Add. 1995, Act 57, Imd. Eff. 5/24/1995 .
