Section 37:2160 - Local regulatory authority; permit offices; staff; building permitsA. Each month the staff of the board may inspect the list of permits issued by each local building permit official in this state to ensure that no person is working as a contractor without an active license. Upon request, parish and municipal permitting authorities shall provide to board staff all unredacted documents relating to building permits, applications, and inspections.B. Prior to the issuance of any building permit, the local building permit official shall require that the applicant for such permit produce proof that the applicant possesses an appropriate, applicable contractor's license issued by the board, or that the applicant's proposed building activity is exempt from such licensure in accordance with this Chapter.C. The local building permit official shall require any applicant claiming an exemption for residential construction activities to execute an affidavit attesting to the claimed exemption. Such affidavit shall be submitted to the local building permit official prior to the issuance of a permit. Such affidavit shall be executed on a form provided by the board.D. The provisions of this Chapter shall preempt any municipal or other local regulatory examination authority over all licensees. If the governing authority or any municipality or parish finds that the state minimum standards do not meet its needs, the local government may provide requirements not less stringent than those specified by the state.Added by Acts 1956, No. 233, §10.
