§ 16. Depot of mechanized equipment—Lease or sale to other agencies or persons

(a) The Secretary of Transportation and Public Works is hereby authorized to lease the equipment and sell the supplies belonging to the Depot of Mechanized Equipment and Materials, to other government agencies, commonwealth or federal, and to the municipalities, and he is hereby authorized to lease equipment and sell materials to public works contractors, and to private entities carrying out works or rendering services of a public nature under contracts, and under such terms as the Secretary of Transportation and Public Works may deem proper. The proceeds derived from the leasing of equipment and the sale of materials shall be covered into the Depot Revolving Fund created by § 14 of this title.

(b) The Secretary of Transportation and Public Works is hereby authorized to sell all such equipment of the Depot of Mechanized Equipment and Materials which for its physical condition is not giving an efficient and economical service, or which becomes unnecessary for the activities of the Department, or which is declared surplus or unserviceable. All sales shall be made through public auction. The sale of equipment declared surplus or unserviceable is hereby authorized to be made to the public corporations, the municipalities, departments, agencies and other instrumentalities of the Commonwealth of Puerto Rico, and to federal agencies without need of a call for bids. The proceeds from the sale of said equipment shall be covered into the Depot Revolving Fund created by § 14 of this title.

(c) The Secretary of Transportation and Public Works is hereby authorized to acquire for the Depot of Mechanized Equipment and Materials, equipment and materials through the procedure of public call for bids without subjection to the provisions of Act No. 96, approved June 29, 1954, and the award shall be made to the reliable lowest bidder, taking into consideration that the equipment and materials to be served meet the terms of delivery and other conditions imposed and conform to the specifications. The Secretary of Transportation and Public Works is further authorized to acquire in the open market equipment and materials for the Depot of Mechanized Equipment and Materials without need of a call for bids, in the case of any purchase which does not exceed $10,000 or which has to be made immediately by reason of emergency or urgent need. The Secretary is hereby authorized to require from the seller good and sufficient warranty so as to assure the fulfilment of the purchase contract, and may prescribe such other terms of said contract as he may deem adequate.

For the purposes of §§ 13—18 of this title, it shall be understood that the term mechanized equipment includes, among others, trucks, hauling platforms and other vehicles not destined for the transportation of passengers and which are used for the construction and maintenance of public works in general.
