§ 572a. Evaluation criteria

(a) Subject to the special provisions note under § 571 of this title, the Commissioner and the Secretary shall establish, through regulations, the documents, information and guarantees to be provided by a film project or infrastructure project to avail itself [of] the provisions of this chapter. The Commissioner may require the film project or infrastructure project to submit the following, for his/her approval, in the applicable cases:

(1) Its budget;

(2) its work plan;

(3) bond;

(4) photography or filming schedule;

(5) development, preproduction, production, post production and construction plans;

(6) purchase orders;

(7) lease contracts;

(8) distribution or sales contracts, and

(9) any other document, information or guarantee that the Commissioner or the Secretary of the Treasury deems necessary or convenient.

(b) The Commissioner and the Secretary shall use the following criteria to evaluate an application for a license:

(1) Reliability and reputation of the natural persons that compose or sponsor the film project or the infrastructure project.

(2) Economic activity that will be generated by the proposed activity including the number of direct or indirect jobs estimated to be generated in Puerto Rico as the result of the film project or the infrastructure project.

(3) Any other factor to be established through regulations.

(c) The application for license shall only be denied for a just cause, which the Commissioner shall have the obligation to state in writing to the film entity.
