§ 144. Corporation; functions

The Corporation is created to fulfill the following main functions:

(a) To scientifically and orderly plan the area of the New Center of San Juan. For the indicated purposes, the Corporation shall be empowered to adopt, amend, supplement, and repeal plans and rules and regulations relative to the planning in a continuous form, the design, the control of the design, the development and the control of the development of the New Center of San Juan. Said plans, rules and regulations shall not have force of law until they have been approved by the Puerto Rico Planning Board. Once so adopted and published in accordance with Act No. 112 of May 16, 1958, as amended, their specific compliance may be required by the Secretary of Justice of Puerto Rico through ordinary or extraordinary civil procedure before the courts of justice.

Notwithstanding the above provisions, the power herein granted to the Corporation for adopting plans, rules and regulations shall not be construed as limiting the other powers and facilites granted by other laws to other departments, agencies or public instrumentalities to exercise such respective powers and faculties within their own sphere of action. Likewise, it must be understood that in the development of the New Center of San Juan, the Corporation shall be subject to, and shall comply with every regulation, rule or requirement established by public authority, as in the case of a private entity, except as otherwise provided in this chapter.

(b) To promote, implement and coordinate the development of the area of the New Center of San Juan. To carry out this function the Corporation shall consult with the Puerto Rico Planning Board, the Land Administration of Puerto Rico, the Puerto Rico Highway Authority, the Public Building Authority of Puerto Rico, the Department of Transportation and Public Works of Puerto Rico, the Urban Renewal and Housing Corporation of Puerto Rico, Trade and Export Company of Puerto Rico, the Electric Power Authority of Puerto Rico, the Aqueduct and Sewer Authority of Puerto Rico, the Municipality of San Juan, and the Program of the Model City of San Juan in everything concerning the public functions corresponding to each one of said agencies or entities.

The development of the New Center of San Juan shall be understood to cover and include, without it being construed as a limitation, the streets, roads, pedestrian thoroughfares, public services, recreation areas, buildings, structures and facilities, as well as all those other aspects necessary to the concept of said Center. The Corporation may operate and be in charge of the partial or total maintenance of the project of the New Center of San Juan and its facilities and may also administer the activities of said New Center and coordinate them with public and private agencies. The Corporation may carry out the publicity campaigns it may deem necessary to advance the project and promote its development and utilization by the appropriate persons and entities.

(c) To grant preference, as far as possible, to native capital engaged in private investments to carry out the purposes of this chapter.
