§ 73f. Supervision and inspection of works

(a) The architect or engineer who supervises or inspects the works, or the construction official or his representative, shall reject works which are not in conformity with the certified plans and specifications, which were approved and endorsed by the agency, and may file complaints pursuant to the provisions of §§ 73—73 l of this title.

(b) Any construction work, covered by the provisions of §§ 73—73 l of this title, which according to regulations is required to be under the inspection of a licensed engineer or architect, must meet the regulatory provisions. The engineer or architect who inspects the works shall file a written certification with the agency, upon the completion of the construction, stating that it was inspected by him and that it complied with the terms of the permit granted in accordance with the certified plans. The agency shall file a copy of the certification as part of the record, plans and documents subject to the approval issued by virtue of § 73c of this title. Due to the periodic nature of the inspection, the certification must respond to the frequency and intensity with which it is carried out, which shall never be inferior to what is required by this chapter or the regulations authorized hereunder. The contractor or constructor, or their employees, shall not certify the inspection of a work constructed by them.

(c) The contractor or constructor, under whose direction the works were carried out, shall present a sworn certification to the agency concerned, guaranteeing that it was carried out in accordance with the plans and specifications for which the construction permit was granted.
