Except in cases of emergency, as established in § 4631g of this title, any person who plans to excavate or demolish shall notify its intention to excavate or demolish to the Excavation and Demolition Coordination Center, and shall coordinate through said Center all excavation or demolition works to be carried out in the jurisdiction of Puerto Rico between the tenth (10th) day and the fourth (4th) working day, prior to the date of the excavation or demolition proposed, excluding Saturdays, Sundays and official holidays.
The notification required by this section shall include the following:
(a) The name of the person who notifies;
(b) the location of the proposed excavation or demolition area, which shall include:
(1) The street or road and the location to be excavated or demolished on said street or road, or
(2) if the street or road is not named or numbered, a precise description of the excavation or demolition area using other available references, such as neighboring streets, roads, intersections or any other sign or point of reference that allows the identification of the location;
(c) the name, address and telephone number of the excavator or wrecker or of the company of the excavator or wrecker;
(d) the telephone number of the excavator or wrecker at the work site;
(e) the date and time in which the excavation or demolition is begun and the date when the excavation or demolition is expected to conclude;
(f) indicate the explosives to be used, if any;
(g) indicate if the area to be excavated or demolished has been marked, and state that said marks shall be kept visible until the beginning of the works;
(h) time schedule of the excavation per day;
(i) machinery and type of machinery to be used;
(j) reason for the excavation;
(k) brief description of the work to be conducted;
(l) indicate whether the project is one of multiple or continuous excavations;
(m) evidence of the permits issued by the Department of Transportation and Public Works, the Department of Natural and Environmental Resources, the municipalities or any other dependency with jurisdiction over such matters, and
(n) to leave the excavation area in the same or in better condition than it was before the work.
The Excavation and Demolition Coordination Center shall issue a control number, in writing, to the excavator or wrecker as evidence of compliance with the obligation of notification imposed by this section. The excavator or wrecker shall mark the area to be excavated or demolished, as provided by the Center through regulations. The excavator or wrecker shall observe the tolerance limits and the approach mechanisms of the installations that are acceptable and reasonable, as provided by the Center through regulations. The excavator or wrecker shall immediately notify the Excavation and Demolition Coordination Center of any underground installation found in the course of the excavation or demolition that was not marked or identified, or that was outside of the passage identified by the operator, which shall in turn notify the operators. The excavators shall inform the [Fire] Department when they deem that flammable material, whether in underground tanks or lines, may be identified in the excavation or demolition.
