Any person who may be adversely affected by a standard promulgated under §§ 361—361aa of this title, or by an order for variance issued under § 361m or 361n of this title, may, at any time prior to the sixtieth (60th) day after the effective date of such standard or order, file a petition challenging the validity of such standard or order with the Court of First Instance, San Juan Part, of the Commonwealth of Puerto Rico, for a judicial review of such standard or order. A copy of the petition shall be forthwith transmitted by the petitioner to the Secretary. The filing of such petition shall not, unless so ordered by the court, operate as a stay of the standard or order. The determinations of the Secretary shall be conclusive if supported by substantial evidence in the record considered as a whole.
