§ 936. Barbiturates and other dangerous drugs—Regulation for the sale of antibiotics

(a) Except as provided in subsection (c) of this section, penicillin and the other antibiotics, and preparations containing antibiotics and mixtures of antibiotics shall not be sold at retail, except on a medical or practitioner’s order or prescription, and such prescription shall be filled by a pharmacist or pharmacy aide registered under the laws of Puerto Rico.

(b) In dispensing an antibiotic the pharmacist shall comply with the provisions of § 934 of this title.

(c) The provisions of subsections (a) and (b) of this section shall not apply to the following antibiotics, by themselves or in combination:

(1) Tyrothricin, penicillin, streptomycin, bacitracin or polymixin in preparations for local skin application.

(2) Tyrothicin, penicillin, chlortetracycline, gramicidin, bacitracin, polymixin, neomycin, tetracycline or oxytetracycline when used in ointments for local application other than for ophthalmic use in the human body.

(3) Tyrothricin, penicillin, polymixin or gramicidin when used in solutions for application to the mucous membranes of the nose or throat.

(4) Troches of penicillin, bacitracin, tyrothricin, gramicidin, neomycin or polymixin.
