§ 730. Regulations; notice, hearing, effective date

(a) The authority to promulgate regulations for the enforcement of this chapter is hereby vested in the Secretary. The said Secretary is hereby likewise authorized to make the regulations thus promulgated conform, insofar as possible, with those promulgated under the Federal Act.

(b) The public hearings authorized or required by this chapter shall be conducted by the Secretary or such officer, agent, or employee as the Secretary may designate for the purpose.

(c) Before promulgating any regulations contemplated by § 719; 721(j); 722; 725(d), (f), (g), and (h), or 729(b) of this title, the Secretary shall give public notice of his intention, fixing the time and place for a public hearing. The regulations so promulgated shall become effective on the date fixed by the Secretary, and which shall be set to fall ninety (90) days after their promulgation. Such regulations may be amended or repealed in the same manner as is provided for their adoption; except that the Secretary may, to such an extent as he deems necessary in order to prevent undue hardship, disregard the foregoing provisions regarding notice, hearing, or effective date.
