§ 326. Hospital licensing; conditions and requirements

The Department of Health shall consider the safety and protection programs designed and implemented to prevent the stealing or kidnapping of newborn infants in said hospital institutions as part of the development, establishment and execution of norms for the licensing of public and private hospitals.

The Secretary may suspend, deny, or revoke the license that authorizes the operation of a hospital institution provisionally or permanently when it is deemed that the provisions of this chapter or the regulations promulgated by virtue thereof, or those of any other regulation that is applicable according to the security requirements and guidelines adopted through this legislation have been violated, and it is determined that the violation is harmful to the interests and security of newborn infants who receive medical services in hospitals.

The administrative hearings held to apply this section shall be governed by the Regulations for Health Facilities in Puerto Rico, promulgated by the Department of Health pursuant to §§ 331 et seq. of this title.
