§ 402. Indemnity for death in the performance of duty

Should a member of the Puerto Rico Police lose his/her life in the performance of his/her duty or as a result thereof, the Commonwealth of Puerto Rico shall be obliged to pay a sum equal to twenty-five thousand dollars ($25,000) as indemnity for the death of such officer to the surviving spouse and to his/her children who are minors or who are full-time students or are disabled. Should both concur, each party shall be awarded fifty percent (50%). Should there be no surviving spouse, one hundred percent (100%) shall correspond to the minor children, full-time students or disabled. In absence thereof, one hundred percent (100%) shall correspond to the surviving spouse. Should there be none of these parties, the sum shall then be awarded to the dependent parents of the originator. For the purposes of this section, the surviving spouse shall be understood to be the person married to the originator at the time his/her demise occurs.

The Superintendent of the Puerto Rico Police shall determine through regulations, in a term of sixty (60) days, when a police officer has lost his/her life in the performance of his/her duty or as a consequence thereof.
