§ 392. Amount of the pension

If the member of the police force at the time of his/her death left only one (1) beneficiary, said person shall receive sixty percent (60%) of the pension received by the deceased member of the Police. If there were more than one (1) beneficiary, the latter shall jointly receive sixty percent (60%) of the pension received by the deceased member of the Police Force. In absence of designation of beneficiaries, the heirs shall receive in equal parts and jointly sixty percent (60%) of said pension.

When it is determined that the minor children beneficiaries of this pension cannot continue enjoying the same, because they have attained their legal age, are not disabled, or not pursuing studies in a higher education institution, as provided in § 395 of this title, or when the minor dies before attaining legal age, the percentage received by the latter shall be adjudicated and the amount received by the surviving spouse shall be increased, subject to the provisions of § 397 of this title.
