§ 342b. Certification and product changes

(a) Each manufacturer shall submit to the Fire Chief of the Firefighters Corps of Puerto Rico a written certification attesting that:

(1) Each type of cigarette listed in the certification has been tested in accordance with § 342a of this title, and

(2) each type of cigarette listed in the certification meets the performance standards set forth in § 342a of this title.

(b) Each cigarette listed in the certification shall be described with the following information:

(1) Brand, or trade name on the package;

(2) style;

(3) length in millimeters;

(4) circumference in millimeters;

(5) flavor;

(6) filter or nonfilter;

(7) package description;

(8) markings, in accordance with § 342c of this title;

(9) the name, address, and telephone number of the laboratory if different than the manufacturer that conducted the test, and

(10) the date the testing occurred.

(c) The Fire Chief shall make the certifications available to the Secretary of Justice for the purposes set forth herein and to the Secretary of the Treasury for the purpose of ensuring compliance with this chapter.

(d) Each type of cigarette certified under this chapter shall be recertified every three (3) years, except as provided in subsection (f) of this section.

(e) The manufacturer shall pay the Fire Chief two hundred fifty dollars ($250) for each certification issued. The Fire Chief is authorized to annually adjust this fee to ensure it defrays the actual costs of the processing, testing, enforcement, and oversight activities required by this chapter.

(f) If a manufacturer has certified a cigarette pursuant to this section and thereafter makes any modification to the cigarette that is likely to alter its compliance with the reduced cigarette ignition propensity standard required by this section, said cigarette shall not be sold or offered for sale in Puerto Rico until the manufacturer retests the cigarette in accordance with § 342a of this title. Any altered cigarette that fails to meet the performance standard set forth in this chapter may not be sold in Puerto Rico.
