§ 2145b. Powers

The Puerto Rico Automotive Technicians and Mechanics Association shall be empowered to:

(a) Exist in perpetuity under that name; to sue and be sued as a juridical person.

(b) Possess and use a seal which it may alter at will.

(c) Acquire rights and assets, real as well as personal, through donation, bequest or contribution among its members, by purchase or in other ways, and possess, transfer, mortgage, rent and dispose of them in any other manner.

(d) Appoint its directors and officials or officers, pursuant to the provisions of its regulations and this chapter.

(e) Adopt its regulations which shall bind all its members and/or amend them in the manner and pursuant to the requirements established therein.

(f) Adopt and enforce compliance of the rules of ethics which shall govern the conduct of the automotive technicians and mechanics, which must be approved and published by the Board of Examiners of Automotive Technicians.

(g) Receive and investigate those sworn complaints filed with respect to the conduct of its members in the exercise of the trade and violations of this chapter, forwarding them to the Association’s directors for pertinent action and, after a preliminary hearing in which the interested party or his legal counsel is allowed to present witnesses and be heard, shall file the corresponding complaint before the Board of Examiners of Automotive Technicians if it finds grounds therefor. None of what is provided in this subsection shall be understood as limiting or altering the power of the Board of Examiners of Automotive Technicians to initiate these proceedings on its own account.

(h) Protect its members in the practice of their trade and aid those who retire due to physical disability or advanced age, through the creation of a relief fund that will also provide aid to the heirs of those who pass away.

(i) Exercise the incidental powers that are necessary or convenient for the purpose of its creation and functioning, and are not in contravention with this chapter.
