§ 1033. Establishment of Board

A Board of Examiners of Occupational Therapy is hereby established attached to the Department of Health, composed of five (5) members, to wit: four (4) occupational therapists and one (1) assistant in occupational therapy who shall meet the requirements provided in § 1035 of this title. The members of the Board shall be appointed by the Governor of Puerto Rico with the advice and consent of the Senate of Puerto Rico.

The members of the Board shall be of legal age, citizens of the United States and residents of Puerto Rico, and shall have practiced their profession for at least five (5) years at the time of their appointment. It is desirable that at least one of the members have teaching experience. No member of the Board may be a shareholder nor belong to the Board of Trustees or the Board of Directors of any university, college or school in which courses leading to the degree of occupational therapist or assistant in occupational therapy are offered.

The members of the Board shall initially be appointed: one (1) member for the term of one (1) year, two (2) for the term of two (2) years, one (1) for the term of three (3) years and one (1) for the term of four (4) years. Upon the expiration of these initial terms, appointments shall be made for a term of four (4) years.

No member of the Board may be appointed for more than two (2) consecutive terms.

The members of the Board shall hold office until their successors have been appointed and qualify.

Appointments for vacancies occurring for reasons other than the expiration of the term established by law shall be until the substitute’s appointment expires.

Three (3) members of the Board shall constitute a quorum and the decisions shall be made by majority vote. The Chairman shall sign all official documents of the Board of Examiners of Occupational Therapy. The Board shall meet at least six (6) times a year to carry out its functions after being summoned by the Chairman, but it may hold as many special meetings as are necessary for the best performance of its functions.

The Board shall have an official seal and shall elect a Chairman from its members during its first meeting or when a vacancy occurs. The members of the Board shall hold their offices ad honorem, but shall be entitled to a fifty-dollar ($50) payment on account of per diems, for each day or fraction thereof they devote to their official endeavours on the Board. Per diems shall be paid pursuant to the regulations adopted by the Department of the Treasury.

The Governor of Puerto Rico may dismiss a member of the Board upon previous notice and hearing for lack of professional ethics, for violations of this chapter, for misconduct or for negligence in the fulfillment of his office.
