§ 555. Examinations and license issuance

Any person over sixteen (16) years of age who wishes to obtain a license for the purpose of engaging in the practice of the profession of cosmetology (beauty specialist), pursuant to the provisions of this chapter shall file an application therefor with the Secretary of State. Said application shall be sworn to and signed before a notary or before any other official authorized by law to administer oaths, and shall contain all such information as the Board may deem pertinent for the best identification of the applicant. The application shall include satisfactory evidence of the moral repute of the applicant, that he does not suffer from any infectious or transmissible diseases and that he has completed at least the eighth grade of the grammar school or its equivalent. It shall likewise include satisfactory evidence that the applicant has successfully completed a course of study in a beauty academy accredited by the Department of Education of Puerto Rico or recognized by the Board, with a minimum of one thousand (1,000) hours of professional practice under the direction of competent teachers or, in lieu thereof, that he is the holder of a provisional license under this chapter. The application shall be accompanied by the fee for said examination provided by this chapter.

The examinations prepared by the Board of Examiners of Beauticians shall not be circumscribed to a single beauty method or system. No license shall be issued to any person who has failed to show that he really and positively meets the minimum requirements to engage in the profession of cosmetology (beauty specialist). Examinations shall be oral and written and shall cover both the theory and the practice, including shampooing, rinses, dyeing, trimming and thinning of the hair, water waving, comb waving, permanent waving, cold waving, manicuring, scientific treatment of the hair and scalp, facial treatment, make-up, eyebrow shaping, hair straightening. They shall also undergo examination concerning their notions of chemistry, physiology, psychology, anatomy, sterilization, health, hygiene, dermatology and bacteriology, electricity (use of professional instruments proper of the field, vibration lamps and application thereof), art of selling professional products, equipment, and instruments proper of the profession (salemanship), shop management, hair styling and any other matter connected with the profession according to the judgment of the members of the Board.

Applicants between sixteen (16) and eighteen (18) years of age shall hold a certificate of employment in accordance with §§ 431-443 and 446-456 of Title 29.

Said examinations shall be held at least once a year at such place and on such date as the Board may determine.

Prior to any of the regular examinations, the Board may, upon application therefor, issue a provisional license to the applicant meeting the aforesaid qualifications. Said provisional license shall be issued for a period comprising from the date of the filing of the application to the date on which the Board holds the next examination and makes a decision on the case.

The fee for the issuance of a provisional license shall be two dollars and fifty cents ($2.50) which shall be paid with the application.

When the applicant has successfully passed the examination and has also met the other requirements for the obtention of a license, the Board shall, upon payment of the fees established by this chapter, issue a license in the name of the applicant authorizing said applicant to practice the profession of cosmetology (beauty specialist) in Puerto Rico.
