§ 23. Number of opportunities to take and pass examinations

(a) An act to provide that persons who wish to take licensure examinations for any profession that so requires shall have unlimited opportunities to take and pass these examinations is hereby created.

(b) Each Examining Board shall establish the requirements and conditions to maximize the probabilities of passing the licensure examination for candidates who have failed over five times. These may include additional formal education in areas to be evaluated, continuing education, reviews, or remedial courses offered by entities approved by the Board, as well as other strategies that the Board deems could assist such candidates.

(c) The provisions of this section shall not apply to the legal profession. Notwithstanding the foregoing, the Supreme Court of Puerto Rico is hereby urged to take notice of the legislative intent set forth in this section and to revise the rules and regulations of the Board of Bar Examiners, to determine whether it would be prudent for candidates for the bar examination to have unlimited opportunities to take and pass the same.
