§ 4015. Penalties

Any person who advertises as a licensed nuclear medical technologist in any advertising medium, or who undertakes the practice of nuclear medicine technology without the corresponding license, shall incur the illegal practice of nuclear medicine technology, which shall constitute a misdemeanor, and upon conviction, shall be punished by a fine of not less than one thousand dollars ($1,000) nor more than five thousand dollars ($5,000), or a term of imprisonment that shall not exceed six (6) months, or both penalties at the discretion of the court.

Any natural or juridical person who employs another person so that the latter may illegally practice the profession of nuclear medicine technology, shall incur a misdemeanor for each day in which he/she incurs said practice. Upon conviction, said person shall be punished with a fine of not less than one thousand dollars ($1,000) nor more than five thousand dollars ($5,000). Furthermore; Provided, That if it [is] in a health services enterprise, the court shall order the revoking of the licenses or operating permits of its owners or the enterprise itself.
