§ 3418. License—Denial

The Board may refuse to issue a license after due notice to the interested party, giving him the opportunity to be heard, when that party:

(a) Does not meet the requirements established by this chapter to obtain the license.

(b) Has practiced the respiratory care technician profession illegally in Puerto Rico.

(c) Has been convicted of a felony or misdemeanor that implies moral depravation.

(d) Has obtained, or tried to obtain, a respiratory care technician’s license through fraud or deceit.

(e) Has incurred in manifest incompetence in the practice of the profession in detriment of a third party.

(f) Has been declared mentally unfit by a competent court or his unfitness is established before the Board through medical expertise; Provided, That the license may be granted by the Board as soon as the person is again declared fit, if he meets all the other requirements established by this chapter.

(g) Is addicted to drugs or alcohol; Provided, That the license may be granted once the person proves he is fit, if he meets all the other requirements established by this chapter.
