(a) Any choice of retirement shall be final and irrevocable. However, during the determination period, the agency, upon consultation with and the consent of the Government Fiscal Agent and the Office of Management and Budget, may cancel any choice of retirement and suspend early retirement for a specific group of eligible employees based on the agency’s economic capacity and needs, and if the total number of choices of retirement made during the selection period do not economically justify, or otherwise, the implementation of the program. If at that moment, the agency determines not to implement early retirement for a specific group of eligible officers and employees pursuant to this section, all choices of retirement shall remain without effect and any employee who had chosen retirement shall remain in his/her job position with the agency and shall continue his/her participation in the Retirement System under the provisions of the Retirement System Act.
(b) The agency shall identify those employees whose experience and knowledge are essential for its sound operations. Any officer or employee so identified by the agency who had chosen retirement shall have the obligation to render training services to those employees [that] the instrumentality determines to have a right to receive payment for said services, prior [to] or after receiving the pension or benefits in accordance with the provisions of this subchapter. Said training services shall be offered for a maximum term of six (6) months.
