(a) The agencies or corporations which have availed themselves of the Program shall not recruit or contract more than ten percent (10%) of the total payroll of employees who have availed themselves of the Program, or exceed ten percent (10%) of the number of employees who have availed themselves thereof, for a term of ten (10) years counting from the date of effectiveness, except through a provision to the contrary issued by Executive Order of the Governor, with the advice of the Government Development Bank or the Office of Management and Budget, as the case may be.
(b) No agency that has availed itself of an Early Retirement Plan pursuant to this subchapter may implement the Increase for Productivity Plan provided in § 4 of Joint Resolution No. 95 of June 27, 1997 of the General Budget.
