§ 138ll. Inspection of records—Denial of access; right of petitioner

Any person who is denied access to the information requested may appear before the Court of First Instance of Puerto Rico.

(a) The court, by petition of the affected party, shall order the Secretary of Justice, or the person designated by him, to submit a list, under oath, of all the documents in the Special Investigations Bureau that have been compiled and are pertinent to the petitioner’s request.

(b) The Secretary, or the person designated by him, shall specify which documents, in his judgment, should not be revealed, stating his reasons for it. The court may order the Secretary to produce them for inspection by the judge with the exclusion of the parties and their lawyer.

(c) Once examined, the court shall order the Secretary to hand over copies of the documents or papers on which there is no objections, or of those which, in spite of the objection, the court deems that they are not protected by the exclusionary criteria established in § 138 l of this title.

In any case, the court shall have ample discretion to regulate and direct these proceedings in such a manner as to guarantee that persons who are alien to the judicial functions shall not have access to those documents, if any, that should not be disclosed.
