The Governor may initiate, through the filing of charges, the procedure for the removal of a member of the Commission for negligence or illegal or improper conduct in the discharge of his office. Said removal procedure shall be initiated by the filing of charges before an Administrative Judge designated by the Governor. The designated Administrative Judge shall order the dismissal of the charges, or shall conduct the investigation he/she deems pertinent.
If after conducting the investigation, it is determined that cause for action exists, the Administrative Judge shall grant a hearing as soon as possible to give the parties the opportunity to be heard, together with their witnesses. If the Administrative Judge finds that the charges have been established, he/she shall issue a final determination and shall proceed to remove the member of the Commission. The member of the Commission thus removed may appeal the decision before the Court of Appeals within a term of thirty (30) days after receiving the notice of the Administrative Judge.
