(a) Civilian employees of the National Guard of Puerto Rico whose salaries are paid from funds of the Government of the United States, who are members of the Employees Retirement System of the Government of Puerto Rico and its instrumentalities under the provisions of § 828 of this title, who, on the taking of effect of this act, are covered by the retirement system for federal government employees, are hereby authorized to waive their participation in the Employees Retirement System of the Government of Puerto Rico and its instrumentalities. In order to be entitled thereto it shall be indispensable to file, prior to the said waiver, the proper application of admission with the Employees Retirement System of the Federal Government and to have been duly accepted.
(b) The said civilian employees of the National Guard of Puerto Rico who decide to waive their participation in the Employees Retirement System of the Government of Puerto Rico and its instrumentalities shall, for the purposes of being covered by the Employees Retirement System of the Federal Government, be entitled to the reimbursement of their accrued contributions from the system waived, plus the interest thereon, except those employees who have given authorization so that their contributions guarantee any benefit provided by said retirement system or who have vested rights in any benefit provided in §§ 761 et seq. of this title.
(c) The provisions of § 828 of this title shall remain in force for the purposes of the participation of civilian employees of the National Guard whose salaries are paid totally from federal funds who may decide to continue being covered by the Employees Retirement System of the Government of Puerto Rico and its instrumentalities.
